1. About These Terms
These Terms of Service govern your use of the SnagSafe website and our professional snagging inspection services. By using our website or engaging our services, you agree to be bound by these terms in accordance with Irish law.
SnagSafe is operated by Glen McCarney, 50 The Belfry, Duleek, Co. Meath, A92FY03, Ireland.
2. Our Services
SnagSafe provides independent snagging inspections for new build and recently renovated residential properties. Our services include:
- Visual inspection of the property interior and exterior
- Identification of defects, unfinished work, and quality issues
- A detailed digital report with photographs
- Post-inspection guidance and support
Our inspections are visual assessments only. We do not carry out structural surveys, Building Energy Rating (BER) assessments, fire safety certifications, or any inspections that require registration with the Construction Industry Register Ireland (CIRI) or certification under the Building Control Acts 1990–2014.
We do not open up walls, floors, or ceilings, and our inspection is limited to areas that are safely and reasonably accessible at the time of the visit. Our service does not constitute an opinion of compliance with the Building Regulations (S.I. No. 497 of 1997, as amended) or Technical Guidance Documents (TGDs).
3. Building Standards Context
While SnagSafe does not provide certification or regulatory compliance assessments, our inspections are informed by an understanding of the standards expected in Irish new build construction, including:
- Building Regulations 1997–2021 (S.I. No. 497 of 1997, as amended) and associated Technical Guidance Documents (Parts A–M)
- Building Control (Amendment) Regulations 2014 (S.I. No. 9 of 2014) — relating to Certificates of Compliance on Completion
- HomeBond / Premier Guarantee structural warranty standards where applicable
- IS 440:2009+A1:2014 — Domestic gas installations
- ET 101:2008 and National Rules for Electrical Installations (ET 101:2020) — for visual assessment of electrical fittings only (we do not carry out electrical testing)
- IS 813:2002 — Domestic gas installation standard
Our reports highlight defects based on expected quality of workmanship and finish. They are not a substitute for statutory certificates, including the Certificate of Compliance on Completion required under S.I. No. 9 of 2014.
4. Consumer Rights
As a consumer in Ireland, you are protected by:
- Consumer Protection Act 2007 — protection against unfair commercial practices
- Consumer Rights Act 2022 — rights regarding services provided to consumers, including that services must be performed with reasonable care and skill, and in accordance with the contract
- Sale of Goods and Supply of Services Act 1980 — implied terms that services will be provided with due skill, care and diligence
- European Communities (Information, Cancellation and Other Rights) Regulations 2013 (S.I. No. 484 of 2013) — 14-day cooling-off period for distance contracts (see Section 6)
Nothing in these terms affects your statutory consumer rights under Irish and EU law.
5. Booking and Payment
- Inspections are booked by contacting us via phone, email, or our website contact form.
- Prices are as quoted at the time of booking and are inclusive of VAT where applicable. Prices may vary for unusually large or complex properties.
- Payment is due on the day of inspection unless otherwise agreed.
- We accept bank transfer and cash payments.
- A booking confirmation will be provided by email or text message.
6. Cancellation and Cooling-Off Period
Your right to cancel (distance contracts): Under the European Communities (Information, Cancellation and Other Rights) Regulations 2013, if you book our services online or by phone (a "distance contract"), you have the right to cancel within 14 days of the booking date without giving any reason.
However, if you request that the inspection is carried out within the 14-day cancellation period and we perform the service, you acknowledge that you will lose the right to cancel once the service has been fully performed.
Our cancellation policy:
- You may cancel or reschedule your inspection at no charge with at least 24 hours' notice.
- Cancellations with less than 24 hours' notice may be subject to a cancellation fee to cover reasonable costs incurred.
- If we are unable to carry out the inspection due to circumstances beyond our control (e.g. access denied by builder, unsafe conditions), we will reschedule at no additional cost.
7. Inspection Reports
- Reports are typically delivered within 24 hours of the inspection via email.
- Reports are prepared for the sole use of the client who booked the inspection.
- While we take every care to identify defects, no snagging inspection can guarantee that every issue will be found. Our inspection is based on what is visible and accessible at the time.
- Reports reflect our professional opinion based on 30 years of trade experience. They are not intended as legal advice, structural engineering assessments, or certificates of compliance under the Building Control Acts 1990–2014.
8. Limitations of Liability
SnagSafe provides a visual inspection service based on professional experience. Subject to your statutory rights under the Consumer Rights Act 2022 and the Sale of Goods and Supply of Services Act 1980:
- We do not accept liability for defects that are concealed, hidden behind finished surfaces, or not visible/accessible at the time of inspection
- We do not accept liability for issues arising after the date of inspection
- We are not liable for any actions or inactions taken by builders, developers, or third parties following our report
- We are not liable for any indirect, consequential, or special loss arising from the use of our report
Our total liability for any claim shall not exceed the fee paid for the inspection. Nothing in these terms seeks to exclude or limit liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by Irish law.
9. Your Responsibilities
- Ensure that access to the property is available at the agreed time
- Inform us of any known hazards, restrictions, or health and safety concerns in accordance with the Safety, Health and Welfare at Work Act 2005
- Provide accurate property details (including Eircode) when booking
- Ensure that the property is in a state that allows a reasonable inspection to be carried out
10. Complaints and Dispute Resolution
If you are dissatisfied with our service, please contact us directly and we will endeavour to resolve the issue promptly. If we are unable to resolve your complaint, you may:
- Contact the Competition and Consumer Protection Commission (CCPC) — www.ccpc.ie — for consumer advice
- Use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/odr for cross-border disputes
- Pursue resolution through the Small Claims Court (for claims up to €2,000) or the District Court under Irish law
11. Intellectual Property
All content on this website — including text, design, images, and logos — is the property of SnagSafe and is protected under the Copyright and Related Rights Act 2000 and the Trade Marks Act 1996. You may not reproduce, distribute, or use our content without prior written permission.
12. Website Use
This website is provided for informational purposes. We make reasonable efforts to keep the information accurate and up to date, but we do not guarantee that all content is complete or error-free. Prices and availability are subject to change without notice. Use of this website is also subject to the eCommerce Directive (Directive 2000/31/EC) as transposed into Irish law by S.I. No. 68 of 2003.

14. Governing Law and Jurisdiction
These terms are governed by and construed in accordance with the laws of Ireland. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the Irish courts.
Where EU regulations apply (including but not limited to the GDPR, Consumer Rights Directive 2011/83/EU, and the eCommerce Directive 2000/31/EC), those regulations shall take precedence to the extent required.
15. Severability
If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
